Pennsylvania gun charges: Man claims gun belongs to wife, not him

Items that may be left behind by others in one's car can sometimes later cause problems for the driver. In one such example, a Pennsylvania man who was pulled over for speeding is now facing gun charges for a weapon found in a purse in his car. He explained to the police that the gun and the purse belonged to his wife.

The 30-year-old man was pulled over on the final Tuesday of July around 11:45 p.m. He was spotted traveling at 63 mph in a 45 mph zone according to the arrest report. After pulling the vehicle over, the police decided to search the car and the driver was asked to open the trunk.

A purse was found inside the trunk, and a nine-millimeter unloaded handgun was found inside the purse. The driver did not have a permit for the weapon, but he said that his wife -- who is the owner -- does have a carry permit. The police also reportedly found marijuana in an amount over one-third of an ounce along with a magazine containing seven bullets.

The Pennsylvania man was booked on gun charges and possession of marijuana. He was released on his own recognizance and is scheduled to appear in court in October. His defense will need to show that the unloaded gun in the purse belongs to his wife and producing her carrying permit should suffice to verify that fact. The defense may also be able to contest the vehicle search that produced the gun and the marijuana by attempting to establish a lack of probable cause.
