4 men facing federal fraud charges

On Aug. 19, four men in Pennsylvania were indicted on serious federal charges based on their alleged involvement in activity relating to health care fraud and controlled substances. The U.S. Attorney's Office claims the four men aided and abetted one another as a part of a scheme to receive benefits through a health program under false or fraudulent pretenses. The scheme had allegedly been ongoing since January 2010, until authorities executed the federal warrant on July 8, 2013.

The Department of Health and Human Services, Pennsylvania State Police, the Office of Inspector General and the Drug Enforcement Administration collaborated on the investigation. The 63-year-old physician and a 51-year-old man were charged with health care fraud and possession with intent to distribute a controlled substance. The physician allegedly supplied prescriptions to obtain excessive amounts of Oxycodone, as well as other narcotics, to people he knew were not using the drugs for legitimate reasons.

Federal authorities also alleged that the physician wrote prescriptions to people who were not his patients, fully aware that that Medicaid would be charged for the unlawful prescriptions. A 46-year-old man and 27-year-old New York man were also faced with charges for health care fraud due to their alleged involvement in perpetrating the scheme. According to federal statutes, the maximum sentence for the health care fraud is 10 years behind bars while the maximum penalty for the controlled substance charge is 20 years. The defendants may also face supervised release and fines as well.

People who are accused of fraud or federal violations may benefit from speaking with a lawyer as early as possible. A criminal defense lawyer might be able to protect defendant's right while investigating the credibility of the charges. Legal counsel may be successful in obtaining reduced sentencing for defendants by negotiating a plea bargain with the prosecution.
