Man won't stand trial on embezzlement charges after stroke

A Harrisburg, Pennsylvania man accused of embezzlement from a local fire department will not face trial after the York County court ruled that he is not mentally competent to mount a defense. The man suffered a stroke in 2010 and currently lives in an assisted living facility.

York County prosecutors arrested and charged the defendant in July 2010, after he had already suffered the stroke. The defendant, who served as treasurer of the Goldsboro Fire Company, was accused of writing checks to himself out of the fire department's accounts. His successor allegedly found that the man embezzled $116,927.21 from the company, using 58 checks the man allegedly wrote in his own name or a separate business he owned. Prosecutors alleged that the white collar theft had been going on for seven years.

However, his attorneys contended that his stroke had rendered him mentally incompetent to stand trial in York County. A forensic psychiatrist examined the man, who now requires the services of an assisted living facility, and concluded that his mental state will not improve in the future and likely will get worse. Therefore, the judge presiding over the case officially dismissed the charges on Sept. 29.

Though the York County case is concluded, the man also faces charges in Dauphin County, though he will have a mental evaluation done in connection with that case as well. He was arrested by Dauphin County authorities in September 2010 on suspicion of embezzling $112,157.64 from the Penbrook Fire Company over the past five years.
