Defending a Vehicular Homicide Charge

In Pennsylvania, a car accident that results in the death of someone can lead to a criminal charge of vehicular homicide, officially called "homicide by vehicle". The sentence upon a conviction is indeterminate. If however, the prosecutor can show that the death occurred because the at-fault driver consumed alcohol or ingested a controlled substance , the driver may face a mandatory three-year prison sentence in addition to other charges received as a result of the accident.

One key strategy then, is to try to show that the accident occurred for reason(s) other than the elevated blood alcohol content of the accused or presence of drugs in the blood system.

As your lawyer, Stephen M. Misko will organize a comprehensive defense effort for you. He will carefully investigate the cause of the accident, calling upon the services of a professional accident reconstruction professional. When it can aid in the defense effort, he can also work with an expert in blood alcohol chemistry or other technical specialties who can challenge the prosecutor's assertions. If the link between the accident and the driver's DUI can be broken, then Mr. Misko will seek a dismissal of the DUI vehicular homicide charge or try to mitigate any penalties.

Stephen M. Misko is a former police officer and prosecutor who knows how the facts can be presented to the detriment of a defendant. He will use his experience and knowledge to aggressively defend you.
