STEPHEN MISKO: Both current clients and former clients and even referral clients have issues relating to parole and probation violations. Parole violations are typically more difficult because you are under the supervision of the courts and in some cases under the supervision of the state.
In probation violations, there's greater leeway in getting you a just resolution. If it's a parole violation you usually just go straight to jail. But if it's a probation violation, then it means that your punishment wasn't as severe in the first place, but you're going to be re-sentenced.
You are entitled to two hearings for a violation of probation. The first hearing dictates whether was probable cause even to violate you for your term of probation. And the second one has to do with if you did violate what would the punishment be.
