STEPHEN MISKO: There are three federal constitutional amendments your must be aware of under the Bill of Rights.

STEPHEN MISKO: The Fourth Amendment, the Fifth Amendment and the Sixth Amendment. The Fourth Amendment being you are secure in your place and in your auto from unreasonable search and seizures. Officers cannot search your house without probable cause. Officers cannot search your car without probably cause.

STEPHEN MISKO: The Fifth Amendment is also very important because it gives you the right not to incriminate yourself. You do not have to give a statement in any form to the police because the Fifth Amendment says you have a right against self-incrimination.
Contained within the Fifth Amendment is the obligation, whether it be a state officer or a federal officer, to advise you of your Miranda rights.

STEPHEN MISKO: Officers must advise you have the right to counsel under the Sixth Amendment before giving statements. If you can waive that right, fine, you can give a statement. Taking your Miranda rights, taking the Fifth is very important. In my position as a defense attorney, I never want you to speak to the police.
I never want you to speak to a federal agent. The damage has already been done. Therefore take the Fifth.
