STEPHEN MISKO: Clients will often come to my office and ask me about driving under the influence charges. And my response is there are three ways to defend against a driving under the influence case.
One, did the officer properly stop you? Did he have a reason to stop you? Two, how did you perform on your field sobriety test? And three, if you submitted to a blood alcohol content exam, either by blood or breath, what was the result?
If you're over the age of 21 and your blood alcohol level is between a .08 and a .099, you're a first tier offender. And what that means is your punishment's going to be less than those whose blood alcohol level exceeds a .1. If you're a .10 to a .159 you're a tier two offender, which means your punishment is going to be a little bit more. And if your blood alcohol level exceeds a .159 then you're going to be classified as a tier three offender.
